Poor Prop 8 supporters. They aren’t doing well—being subjected to the rules of evidence in a court room. How unfair that they should have to back up their claims that the world will end if same-sex marriage is allowed. It’s just common sense right?

They shouldn’t have to prove what they just know to be true.

I just can’t help but be a little tickled by the recent events in court, with same-sex marriage opponents being forced to put aside the ridiculous sound bites and fear-mongering arguments against same-sex marriage and actually come up with a factual and evidence-based case. And fail. Miserably.

There is no evidence for any arguments against same-sex marriage. When examined under the microscope of logic, there’s nothing there. The courts recognized this and quite reasonably and rightly tossed out Prop 8.

It’s fairly easy to predict that the pending appeal will follow in a similar fashion and they will fail to provide any viable reason for them to be allowed to proceed. We will no doubt, be subjected to cries of activist judges and subverting the will of the people. But you know, I don’t mind so much, subverting the will of the people when they are running around poking innocent people with pitch forks and stringing them up by the nearest oak tree.

The will of the people is often misguided, vengeance, fear or anger-based stupidity. It’s not always sacred nor should it be. It’s certainly not a viable argument for implementing policy that turns a segment of our society into second-class citizens with less rights than others.

Women not being allowed to vote was, at one time, the will of the people.

Slavery was, at one time, the will of the people.

Lynchings were, at one time, the will of the people (ok, only some people, but you get my point).

I heard someone say once, that liberals make the mistake of believing that truth and reasonable argument based in fact will successfully convince conservatives that liberal ideas have merit. Unfortunately, this is far more true than I prefer it to be. As a group, Americans are far too easily swayed by flag waving and fear mongering. I am thrilled to see there is still a place where a difference can be made based on logical argument and evidence.
